These terms govern the use of Baymonk, the social listening and competitive intelligence platform operated by WIPERNET, LLC (Wiper Agency) ("the provider"), by the agencies and brands that contract it ("the client").
Provider address: 7900 Oak Lane Suite 400, Miami, FL 33016, United States.
1. The service
Baymonk centralizes, for each brand the client manages: social listening (comments and sentiment), monitoring of public Ad Libraries, reports on its own paid media, community evolution, and analysis and reports generated with artificial intelligence on that data.
2. Accounts and access
The client manages which people on its team have access and with what role. Each person is responsible for keeping their password secure. The provider may suspend accounts in the event of misuse or a security risk.
3. Connections with third-party platforms (OAuth)
By connecting Meta, Google, or other platform accounts, the client states that it has legitimate authorization over those accounts and assets (pages, ad accounts, profiles). Use of those connections is also subject to each platform's terms. The provider is not responsible for access that the client itself grants improperly.
4. Data ownership
The data in the client's accounts and its connections belongs to the client. The provider processes it on the client's behalf and at its direction to provide the service, in accordance with the Privacy Policy.
5. AI-generated content
The platform's summaries, classifications, and recommendations are generated with artificial intelligence models from the providers identified in the privacy policy, according to the administrator's configuration. They may contain errors or omissions: they are working material for the client's team, not binding professional advice, and decisions made based on them are the client's responsibility.
6. Actions on client accounts
Some features publish real content on the client's accounts (for example, replying to or hiding a comment from the moderation inbox). These actions are always executed by a decision of a person on the client's team; AI only drafts. A record of each action is saved on the platform.
7. Availability and limits
The publisher allows publishing to authorized Facebook pages, Instagram professional accounts, and YouTube channels, after reviewing the material, account, and options, and expressly confirming each submission. The platforms determine the available permissions, their limits, moderation, and the final result. Confirmation of receipt does not mean the content has finished processing.
By using the YouTube integration, you also accept the YouTube Terms of Service.
The Publisher allows sending content to the TikTok account the client authorizes, after reviewing the material and confirming consent. The client must have the rights to the content and music, and declare any applicable commercial collaborations. TikTok determines availability, limits, and the final result of each submission; sending a video to continue in TikTok does not mean publishing it. Baymonk shows the status returned by the platform.
- The service is provided on a reasonable best-efforts basis, without any guarantee of uninterrupted availability.
- Some data comes from public sources and third-party APIs that may change, limit, or interrupt access without notice; the provider does not control those sources.
- When a data point is an estimate or an approximation, the platform states it as such in the interface itself.
8. Termination
Either party may terminate the relationship as agreed in the corresponding commercial proposal. Upon termination, client data is deleted in accordance with section 5 of the Privacy Policy.
